TERMS AND CONDITIONS

Updated as of 8 August 2023.

The following terms and conditions (“Terms and Conditions”) apply to the #TakeMeToParadise Contest (the “Contest”) organised by or on behalf of Mandai Park Development Pte. Ltd. (the “Organiser”) conducted through the Instagram page of the Organiser's corporate brand, Mandai Wildlife Group (@mandaiwildlifereserve). By submitting a Contest Entry (as hereinafter defined in the Contest Details below) to the Contest, each Participant (as hereinafter defined) agrees and acknowledges that they have read, understood and accepted these Terms and Conditions. The Organiser reserves the right to make any amendments, additions, replacements and modifications to the Terms and Conditions from time to time without prior notice.

  1. The Contest is open to all participants of at least 18 years of age, who are citizens or permanent residents with local residential addresses in the following countries: Australia, India, Indonesia, Japan, Malaysia or the Philippines (a “Participant”).
  2. As a condition of entry into the Contest, each Participant affirms and represents that they are either: (a) 18 years of age and older and agrees to be bound in all respects by these Terms and Conditions; or (b) if a Participant is below 18 years old, the Participant must and will be deemed to have in any event, obtained consent from their parent or legal guardian, their parent's or legal guardian's acceptance of these Terms and Conditions and their parent's or legal guardian's agreement to take responsibility for the Participant's acts and omissions in connection with their entry into this Contest and/or use of the Prizes (as hereinafter defined in the Contest Details below), as the case may be. The Organiser shall have the right to request proof of their parent's or legal guardian's consent at any time.
  3. Participants must use their own registered Instagram account to enter the Contest.
  4. Participants can submit multiple Contest Entries for the Contest.
  5. The Organiser does not assume any responsibility for any Contest Entry that is incomplete, incomprehensible, unreadable, ineligible, corrupted, misdirected, lost, or delayed, or that are unable to be submitted or published on Instagram due to technical or transmission failures of any kind or any other reason.
  6. Each Participant represents and warrants that any personal data the Participant discloses to the Organiser is complete and accurate. Each Participant shall fully indemnify the Organiser against any loss or damage that may result from their breach of this Clause.
  7. Any personal data or information that the Participant provides to the Organiser is subject to the Organiser's Data Protection Policy (available at https://www.mandai.com/en/saving-wildlife/our-policies/data-protection.html), which is incorporated by reference into these Terms and Conditions. For the avoidance of doubt, all personal data and information provided to the Organiser for the purposes of this Contest will be used by the Organiser for the purposes of administering this Contest only.
  8. Participants must ensure that their Instagram account settings are set as open to the public for viewing during the full duration of the Contest Period and the Judging Period (both as hereinafter defined in the Contest Details below).
  9. By entering this Contest, the Participant agrees that all intellectual property rights (“IPRs”) in each Contest Entry shall vest in and be the absolute property of the Organiser. The Participant warrants that it has the authority to transfer or assign all IPRs to the Organiser, or otherwise vest such IPRs in the Organiser. All IPRs capable of vesting in accordance with this Clause without the need for any transfer or assignment to be executed by the person generating the same shall vest in the Organiser by virtue of this Clause along without the need for any transfer or assignment. All IPRs incapable of vesting in accordance with this Clause without the need for a transfer or assignment to be executed by the person generating the same, shall be arranged by the Participant to be vested in the Organiser. Subject to the provisions herein, the Participant shall not disclose, release or sell to any persons or otherwise deal with the IPRs in any manner whatsoever without the Organiser's prior written consent.
  10. Participants who complete the Contest Mechanics as stated in the Contest Details below will be eligible to stand a chance to win the Prizes. Their Contest Entries shall be judged by the Organiser based on three (3) criteria: authenticity, creativity and relevance (the “Judging Criteria”). Further details are set out in the Contest Details below.
  11. All Prize winners will be notified by the Organiser (the “Organiser's Notification”) via Instagram's private direct messaging function (“Instagram DM”) to the Participant's Instagram account, which must have been the same account used to enter the Contest. Further details are set out in the Contest Details below.
  12. If a Prize winner does not respond and claim the Prize in writing by way of Instagram DM within seven (7) days from the date of the Organiser's Notification, the Prize Winner shall be deemed to have forfeited the Prize and the Organiser reserves the right to select and notify an alternative Prize winner in accordance with the Judging Criteria, forfeit the Prize or donate the Prize to charity. Any Prize winner whose Prize have been unclaimed/unredeemed or forfeited hereunder shall not be entitled to any payment or compensation.
  13. All Prizes must be claimed in the manner and by the date notified by the Organiser, which may be changed at the Organiser's sole discretion without prior notice.
  14. As a condition to the award and collection of the Prizes, all Prize winners of the Contest shall:
    1. provide proof of identity, age and residency and such other documents as the Organiser may reasonably require. If the Prize winner is unable to provide satisfactory proof, they shall be deemed to have forfeited the Prize;
    2. keep their winning Contest Entry available for public view until the end of the Campaign Period (as hereinafter defined in the Contest Details below).
  15. By accepting a Prize:
    1. each Prize winner consents to the collection and public disclosure of their Instagram handles and winning Contest Entry on the Organiser's relevant platforms (including but not limited to the Organiser's website and other social media platforms) for audit, publicity and/or commercial purposes in relation to any and all of the Organiser's promotional and marketing activities, including this Contest. Each Prize winner further agrees to participate in any advertising, promotion, media interviews and publicity activities stipulated by the Organiser in relation to the Contest, and to provide and permit the use of their personal data for any future marketing efforts and media publicity by the Organiser's promotional and marketing activities. Accordingly, unless otherwise permitted by the Organiser, failure to comply or refusal to agree with this clause shall result in disqualification and forfeiture of all relevant Prizes; and
    2. the Grand Prize winner agrees to share a photograph of their visit to Bird Paradise with the Organiser within two (2) weeks of the said visit; and
    3. the Grand Prize winner consents to the collection and public disclosure of the photograph on the Organiser's relevant platforms (including but not limited to the Organiser's website and other social media platforms) for audit, publicity and/or commercial purposes in relation to any and all of the Organiser's promotional and marketing activities, including this Contest.
  16. The Organiser reserves the right to deny or claw back any Prize awarded to any Prize winner should the Prize winner subsequently be found to be disqualified or ineligible to participate in the Contest, or in violation of any of these Terms and Conditions.
  17. In the event of a dispute arising from or in connection with the Contest, the Organiser's decision on all matters relating to the Contest and these Terms and Conditions is final, conclusive and binding on all Participants and no correspondence or appeals will be entertained.
  18. Prizes are non-refundable, non-transferable, non-exchangeable for cash, credit, goods or benefits-in-kind, and non-extendable in validity. There shall be no refund, transfer, exchange or extension for any partially used or unused Prize. The Prize is only valid for redemption for a period of six (6) months from the date of prize award (both dates inclusive), after which the Prizes shall be deemed forfeited, and there shall be strictly no extensions. The Organiser will not entertain any appeals whatsoever. The Organiser reserves the right to replace or change prizes with items of similar value without prior notice.
  19. Save to the extent permitted by law, the Organiser shall not in any circumstances be liable to the Participant for any loss or anticipated loss of profit, loss of revenue, loss of use, loss of contract or other opportunity (whether direct, indirect or consequential) nor for any consequential, incidental or indirect loss or damage of any kind whatsoever.
  20. Save to the extent permitted by law, the Participant agrees to indemnify and hold harmless the Organiser and/or the Organiser's related corporations (as defined in the Companies Act 1967) (including parent companies), directors, officers, employees, agents or contractors (the "Indemnified Parties") from and against all claims, demands, actions, judgments, damages, losses, costs, expenses, penalties and liabilities of any nature which the Organiser and/or the Indemnified Parties may suffer or incur for any death, injury, accidents, loss, or damage caused by any negligence, act or omission arising from or in connection with (a) the participant's participation in the Contest, (b) the infringement of any IPRs or similar rights of any third party, or (c) the use or acceptance of any Prize.
  21. By submitting any Contest Entry, the Participant warrants that the work is their original creation and that they are the sole owner and rights holder of the work. The Participant also warrants that they have the right to submit the work to the Contest and grant all necessary licences. The Participant agrees not to submit any Contest Entry that:
    1. infringes upon any third party's rights, including but not limited to proprietary, intellectual property, industrial property, personal, or moral rights, such as copyright, trademark, patent, trade secret, privacy, publicity, or confidentiality obligations; or
    2. violates any applicable laws or regulations.
  22. All Contest Entries must not contain any material or promote any activities that are sexually explicit, obscene, pornographic, violent (such as sales or use of weapons, cruelty, abuse, etc.), discriminatory based on race, sex, religion, natural origin, physical disability, sexual orientation, or age, or illegal (such as underage drinking, substance abuse, computer hacking, etc.). Contest Entries must not be offensive, threatening, profane, or harassing or otherwise deemed inappropriate in the sole discretion of the Organiser. Additionally, the Contest Entry shall not contain any derogatory references to the Organiser or any other person or entity, including the brands or trademarks of the Organiser or any other person or entity.
  23. The Organiser reserves the right to refuse the participation of any person in the Contest and/or disqualify any Participant for any reason whatsoever, including but not limited to unsafe, unruly or undesirable behaviour as stated in the Clause above.
  24. The Organiser shall not be liable for any unlawful or unlawfully produced Contest Entry.
  25. The Organiser reserves the right to cancel, modify or suspend the Contest at its sole discretion, at any time and without prior notice.
  26. The Contest is in no way endorsed, sponsored or administered by or associated with any social media platform.
  27. Any provision in the Terms and Conditions which is held to be invalid or unenforceable for any reason by any court, governmental department, body or tribunal, or in any applicable jurisdiction shall be ineffective to the extent of such invalidity or unenforceability and will not invalidate or render unenforceable the remaining unaffected provisions hereof and should any provision be held invalid or unenforceable in an applicable jurisdiction such provision shall not be invalidated or rendered unenforceable in any other jurisdiction.
  28. The Organiser reserves the right to amend, modify or delete any content and information regarding the Contest on its official website or on Contest-related collaterals/materials; to correct any errors in any notified Contest Mechanics, evaluation of the Contest Entries, or Contest results and Prize winners at any time, without providing any prior notice. Any such changes shall be effective and binding once it has been updated on the Organiser's official website and/or Instagram. The Organiser accepts no liabilities arising from or in connection with these corrections or amendments, including without limitation any liabilities from the change in the winners resulting from the correction.
  29. In the event of any inconsistency between these Terms and Conditions and any other form of publicity collaterals relating to the Contest, these Terms and Conditions shall prevail.
  30. All decisions made by the Organiser regarding the interpretation and application of these Terms and Conditions or on all matters relating to the Contest shall be final and conclusive in each case.
  31. Unless otherwise mentioned herein, these Terms and Conditions are not intended to confer rights to any third party under the Contracts (Rights of Third Parties) Act (Cap. 53B).
  32. The Contest and its Terms and Conditions shall be governed by the laws of the Republic of Singapore and all registered users and the winners agree to irrevocably submit themselves to the non-exclusive jurisdiction of the Singapore courts in the determination of any matter or dispute arising from or in connection with this Contest.

Mandai Wildlife Reserve #TakeMeToParadise Contest Details

Contest Mechanics:

The details on how to take part in the Contest and how to stand a chance to win the Contest are as stated below (the “Contest Mechanics”):

  1. A contest entry submitted for the Contest (the “Contest Entry”) must satisfy the following requirements to be eligible for the Contest:
    1. On the Instagram page of the Organiser (@mandaiwildlifereserve), like the Contest post and follow @mandaiwildlifereserve.
    2. Take a photo or video reel depicting what paradise means to you.
    3. Upload it onto your Instagram feed.
    4. Start your caption with “#TakeMeToParadise from [Your Country]” and tell us what paradise means to you.
    5. Tag @mandaiwildlifereserve and hashtag #BirdParadise in the Contest Entry.
  2. Participants must ensure that their Instagram account settings are set as open to the public for viewing during the full duration of the Contest Period (as hereinafter defined) and the Judging Period (as hereinafter defined).

Contest Period:

  • The Contest shall commence when the Contest is posted on the Instagram page of the Organiser (@mandaiwildlifereserve) on 1 July 2023 (Saturday) and end at 12:00:00 PM Singapore time on 21 August 2023 (Monday) (the “Contest Period”).

Judging Period:

  • The judging period shall commence at 12:00:01 PM Singapore time on 21 August 2023 (Monday) and end at 12:00:00 PM Singapore time on 1 September (Friday) (the “Judging Period”).

Expected Date of Notification to Prize Winners:

  • All Prize winners will be notified via the Organiser via Instagram's private direct messaging function to the Participant's Instagram account on the week of 4 September 2023, or such other later date as may be determined by the Organiser and/or notified on the Organiser's official website and/or Instagram.

Campaign Period:

  • The Campaign shall be for the period from the start of the Contest Period to 12:00:00 PM Singapore time on 15 September 2023 (Thursday) (the “Campaign Period”).

Contest Prizes:

  • Grand Prize:
    • 1 (ONE) pair of Singapore Airlines Economy Class Round Trip Air Ticket to Singapore (the “Grand Prize”) with a one-year validity till 31 August 2024.
    • 2 (TWO) nights' stay in a Singapore hotel room.
    • 1 (ONE) pair of adult admission tickets to Bird Paradise.
  • Consolation Prize:
    • 18 (EIGHTEEN) sets of the Bird Paradise Adventure Gift Pack, each worth up to SGD80 (each, a “Consolation Prize”).

Judging Criteria:

Participants' entries will be judged by the Organiser based on these three (3) criteria: authenticity, creativity and relevance.

Authenticity refers to the genuineness of the entry. The Organiser will assess whether the entry is the participant's own work, and whether it represents a unique perspective or approach. Entries that are plagiarised, copied or inauthentic in any way will receive a lower score in this category.

Creativity refers to the originality and novelty of the entry. Judges will assess how innovative and imaginative the entry is. Entries that demonstrate a high level of creativity will receive a higher score in this category.

Relevance refers to how well the entry relates to the given theme. Judges will assess whether the entry photo and/or video reel and caption directly address the theme, and whether they present a compelling argument or perspective. Entries that are relevant to the theme will receive a higher score in this category.

Prize Collection:

  • 1 (ONE) Grand Prize will be administered and provided by the Organiser to the winner.
  • 18 (EIGHTEEN) Consolation Prizes will be administered and delivered to winners by the Organiser.

The Grand Prize Winner shall redeem their flight ticket through the Organiser's appointed travel partner and/or agency (if any). The Organiser shall provide the Prize Winners with the contact details of the appointed travel partner and/or agency (if any) and it shall be the Prize Winner's responsibility to take such steps to make contact with the appointed travel partner and/or agency (if any) so as to redeem the flight tickets and conclude a booking.

The Grand Prize is only valid for redemption for a period of seven (7) months from the end of the Campaign Period, i.e. by 31 March 2024, after which the Grand Prize shall be deemed forfeited, and there shall be strictly no extensions. The Grand Prize redemption date must be at least three (3) months before the travel date. The Grand Prize flight booking must be for direct flights from international airports of major cities and does not include domestic connecting flights. The flight booking must depart to or return from the same country (e.g. a flight departing from Thailand must return to Thailand).

The Grand Prize flight booking is exclusive of flight fuel surcharges, insurance surcharges, other taxes and fees (airport departure and arrival taxes, airport usage fees, etc.) imposed by each government/airport, which shall be payable by the Grand Prize Winner.

The Grand Prize Winner acknowledges that in order to redeem the Grand Prize flight ticket and/or otherwise be allowed onboard the flight as a passenger, the appointed travel partner and/or agency may impose such other requirements, terms and conditions. The Organiser is not and does not purport to act as an agent of the appointed travel partner and/or agency.

The Grand Prize includes two (2) nights' stay in a Singapore hotel room and a pair of admission tickets for two (2) adults to Bird Paradise.
